1. Acceptance of Terms

These Terms and Conditions govern the supply of all goods and services ("Products") by The Standeaven Collection ("we", "us", "our") to you, the purchaser, through our website ("Website"). By accessing our Website or completing a purchase, you agree to be bound by these Terms and Conditions.

These Terms apply to all customers located within New Zealand and Australia and are effective from the date published. They replace all prior terms and conditions.

We reserve the right to update or amend these Terms at any time. Any changes will take effect once published on our Website.

To complete a purchase, customers must accept these Terms and Conditions via click-through acceptance at checkout.

2. Eligibility to Purchase

There is no minimum age requirement to make a purchase from our Website.

Purchases may be made for personal or gift purposes. Products may not be purchased for resale, whether for commercial purposes or otherwise.

If you are purchasing on behalf of a business or other entity, you warrant that you are authorised to agree to these Terms on its behalf.

3. Handmade Nature of Our Work

All pieces sold by The Standeaven Collection are hand-built, handmade ceramics. Our work celebrates individuality and embraces what we describe as beautiful flaws.

Due to the handmade process, natural variations in shape, size, colour, glaze, texture, and finish are to be expected and are not considered faults. By purchasing from us, you acknowledge and accept these characteristics as an inherent part of handmade ceramics.

4. Commissions

For all commissioned work, a 50% non-refundable deposit is required before work begins.

The remaining balance is payable prior to dispatch or collection of the completed piece(s).

Estimated timeframes for commissions will be provided as a guide only. As all work is handmade, timeframes may vary.

5. Availability and Supply

All orders are subject to product availability. If a product becomes unavailable after an order is placed, we will notify you as soon as reasonably possible.

We reserve the right to limit quantities or discontinue products at any time.

6. Pricing

All prices are listed in New Zealand Dollars (NZD) and include GST, unless stated otherwise. Prices do not include delivery charges.

Prices are correct at the time of publication but may change without notice.

An invoice or receipt will be sent to the email address provided at checkout. You are responsible for ensuring your contact details are accurate.

We currently accept bank transfer only.

Payment details will be provided at checkout. Orders will not be processed or dispatched until full payment has been received.

All payments are processed securely through our nominated payment provider. We do not store credit card details.

8. Shipping & Delivery

We currently ship to New Zealand and Australia street addresses.

Shipping costs are calculated at checkout once delivery details are entered.

We aim to dispatch orders within a reasonable timeframe; however, delivery times may vary due to carrier delays or unforeseen circumstances.

Ceramics are fragile by nature. While we take great care in packaging, breakages can occasionally occur during transit. If your item arrives damaged, please contact us as soon as possible with photographs of the damage.

Where reasonably possible, we will endeavour to repair or replace damaged items. Due to the handmade nature of our work, exact replacements may not always be possible.

9. Returns & Refunds

We do not have to provide a refund if you have changed your mind about a purchase, so please choose carefully.

If a product is faulty, damaged (excluding shipping-related breakage addressed above), or does not meet the guarantees provided under the Consumer Guarantees Act 1993, we will meet our obligations to provide a remedy, which may include repair, replacement, or refund where appropriate.

Natural variations inherent in handmade ceramics do not constitute faults.

10. Limitation of Liability

Where you acquire goods or services for business purposes, the Consumer Guarantees Act 1993 does not apply.

To the fullest extent permitted by law, we exclude liability for any loss or damage except where caused by our bad faith or where liability cannot be excluded under New Zealand law.

Our maximum liability, where applicable, is limited to the value of the product supplied.

While we take reasonable care to ensure information on our Website is accurate and current, we do not guarantee the completeness or accuracy of all content.

12. Privacy & Confidentiality

We collect and use personal information in accordance with the Privacy Act 2020.

Personal information is used solely to process orders, manage payments, and communicate with customers. We do not share personal information except where required by law.

You may request access to, or correction of, your personal information at any time.

Our Website may use cookies to enhance functionality. Disabling cookies may affect your ability to use some features of the Website.

13. Governing Law

These Terms and Conditions are governed by the laws of New Zealand. The New Zealand courts have non-exclusive jurisdiction over any disputes arising in connection with these Terms.

14. General

Failure to enforce any right does not constitute a waiver of that right.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

We may provide notices to you via the email address supplied at checkout.

We recommend seeking independent legal advice to ensure these Terms and Conditions fully meet your business requirements.
